Question: Describe about the Memorandum for Management and Law. Answer: Facts of the case In the following case BC is a company which is manufacturing cars. The company develops a self-driving car called the T2016 model that can drive itself using "Self-Drive technology designed in-house by the company's engineers. The company insists to all its customers who want to purchase the car that they have to sign a contract that include subsequent clauses.- "You must at all times keep your eyes on the road, your hands on the steering wheel and be prepared to take over the "Self-Drive mode despite it being activated at any time. In the event of any claim for breach of contract, the companys liability for compensation will not exceed $5,000. Tom plays on behalf of the Australian Olympic rowing team and he purchased the car for $20,000. And in and in his haste to drive his new car, he signed the contact without reading .The company salesperson Jill tried to explain him all the clauses of the purchase contract but Tom however was not interested in what she had to say and instead he proceeded to take delivery of his new car. One day he activated the "Self-Drive mode whilst travelling, he was very tired on that day and he fell asleep on the driver's chair and the automobile met with a misfortune. It was acknowledged by BC afterward that the "Self-Drive mode on that exacting automobile was defective due to the negligence of one of its engineers he failed to check the wiring of that particular car. Due to slack cabling, the "self-drive mode was temporarily disabled and his car crashed into a ditch. Unfortunately for Tom, he sustained leg and arm injuries from the accident that would prevent him fromcompetitive sport for the rest of his life. Tom is obviously very upset and he sues the company for contact breach (Engineers Australias national congress approved a new code, 2016). Answers and discussions Clients are the most significant and precious property for any business organization. Company should provide and supply the goods and services which are of top-quality, to the clients at rational rates. No advertisement which is fake, lying anddeceptive should be presented in front of customer.Proper arrangements should be there to handle customer grievances and requests. There should be a Commitment to provide high-class goods and the goods and products should be fitted for the required purposes. Customer support post-sales, services , the cost should be appropriate and it should be as per standards which should not lack the quality of the product or service. The promises done with the Customers should not be fake. The company should Repair, replace, the product not meeting their Customer expectations. The company should always Respect the customers time. Company should not keep their customers waiting. The company should not forget that there are numerous options available in the market Companys loss are someone elses gain (Management Study Guide, (N.A). The company should have after sales service and it is necessary and ensures long term growth and profits for the organization. The company should always be in touch with the clients subsequent to the deal also as because we wish to survive in this cut throat competition. We should not ignore the calls when once we have sold the product. If the customer is not pleased with the companys product, then it is the responsibility of the company to replace it or provide a solution for it. Customers feedbacks should be taken which helps our company to understand the satisfaction level of our customers and how we could can make the product better in future (NCAT NSW civil and administrative tribunal, 2016). The company should test the product before it is sold to the customer .So that in future similar time of cases will not occur. When any automobile is sold by the company it should be roadworthy at the time of deal. A Safety Inspection Report is given to the customer, also known as pink slip, and it states that the means of transportation is roadworthy. So the company should also provide pink slip to its customers (Legal and western Australia, N.A). The company should attach to the vehicle a notice containing the true particulars of the vehicle. Because as per motor dealers act 1974, it requires a dealer who offers or displays for sale a motor vehicle, to attach to the vehicle a notice containing the true particulars of the vehicle ( NCAT NSW civil and administrative tribunal, 2016). Conclusion Company has to take many additional actions so that the sale of the company improves. The foremost responsibility is that consumer is satisfied so the company should take further and more actions for consumer satisfaction.
